Release of Liability Waiver v.2
This Release and Waiver of Liability (referred to as the “Release”) executed by the Visitor in favor of Ecotopia Council and CFC Land, Inc. including their partners, directors, officers, employees, contractors, and agents (collectively, the “Organization”)
The Visitor (you), hereby freely, voluntarily, and without duress agrees to this Release of Liability under the following terms:
Release and Waiver: Visitor does hereby release and forever discharge and hold harmless Organization and its successors and assigns from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from Visitor’s Activities with Organization.
Visitor understands that this Release discharges Organization from any liability or claim that the Visitor may have against Organization with respect to any bodily injury, personal injury, illness, death, or property damage that may result from Visitor’s Activities with Organization, whether caused by the negligence of Organization or its officers, directors, employees, agents, or otherwise.
Visitor also understands that Organization does not assume any responsibility for, or obligation to provide financial assistance or other assistance, including but not limited to Visitor’s Activities with Organization. If Visitor needs medical treatment, Visitor agrees to be financially responsible for any costs incurred as a result of such treatment. Visitor is aware and understand that I should carry their own health insurance.
Assumption of the Risk: Visitor understands that the Activities may include work, conditions, occurrence and resulting effects that may be hazardous to the Visitor, including but not limited to, construction, heavy lifting, sun stroke, poison oak, heat exhaustion, flood, fire, earthquake, dehydration, snakes, wild animals, and transportation to and from the work sites.
Visitor hereby expressly and specifically assumes the risk of injury or harm in the Activities and releases Organization from all liability for injury, illness, death or property damage resulting from the Activities. Visitor understands that these injuries or outcomes may arise from their own or others actions, inaction, or negligence; conditions related to travel; or the condition of t Activity locations(s). Nonetheless, Visitor assumes all related risks both known or unknown related to or in connection with Visitor’s participation in this Activity, including travel to , from and during the Activity.
- Insurance: The Visitor understands that, except as otherwise agreed to by the Organization in writing, Organization does not carry or maintain health, medical, or disability insurance coverage for any visitor.
Volunteering: The Visitor may opt to serve as a volunteer and/or contribute in the Energy Exchange program for the Organization and engage in the Activities related to being a Volunteer (the “Activities”) and in consideration of Organization allowing Visitor to engage in Activities enters into this Release. The Visitor understands that the Activities may include, among other dangerous activities, construction and demolition, cleaning and rehabilitating rural and wild lands, working on habitat restoration, working in a river and on a flood plain, removing dangerous, sharp, or hazardous materials. The Activity is to occur at 2566 Matilija Canyon Road, in Matilija Canyon, Ojai, California in general, and in the greater Ventura County Area.
Photographic Release: Visitor does hereby grant and convey unto Organization all right, title, and interest in any and all photographic images and video or audio recordings made by Organization during the Visitor’s Activities with Organization, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographs or recordings.
Hold Harmless: Visitor agrees to hold Organization harmless from any and all claims, including attorney’s fees or damage to personal property that may occur as a result of Visitor’s participation in this Activity, including travel to, from, and during the Activity. If Organization incurs any of these types of expenses, Visitor agrees to reimburse Organization.
Promise not to Sue: Visitor promises not to sue Organization for any and all claims arising out of participation in Activity.
Interpretation: Visitor expressly agrees that this Release is intended to be as broad and inclusive as permitted by the laws of the State of California. If this Release does not include a release or waiver of liability allowed under the laws of the State of California that would prevent liability in Organization, Visitor agrees that this Release should be interpreted to include such a release or waiver.
